裁判を受ける権利というより、裁判請求権

憲法32条の「裁判を受ける権利」というのは受け身です。
これを、「裁判を請求する権理」と呼ぶべきです。
裁判請求権です。
公正裁判請求権。
公正適正裁判請求権。
Anspruchs auf rechtliches Gehör です。
法的聴聞権、法的審尋請求権、法律請求権、正義請求権です。


憲法32条
第三十二条 　何人も、裁判所において裁判を受ける権利を奪はれない。

Article 14
1. All persons shall be equal before the courts and tribunals. In the determination of any criminal charge against him, or of his rights and obligations in a suit at law, everyone shall be entitled to a fair and public hearing by a competent, independent and impartial tribunal established by law.

第14条
1 　すべての者は、裁判所の前に平等とする。すべての者は、その刑事上の罪の決定又は民事上の権利及び義務の争いについての決定のため、法律で設置された、権限のある、独立の、かつ、公平な裁判所による公正な公開審理を受ける権利を有する。
